Terms of Use for Company
Any person or entity which submits job or position listings or information on the CAD Recruiter.com website, is referred to as the "Company" for all purposes and is subject to the following terms and conditions:

1) Company's sole purpose in using services provided by Brighton Designs, Inc. d/b/a/ CAD Recruiter.com (hereinafter referred to as "Brighton Designs") is to use the CAD Recruiter.com website to attract and identify candidates and prospects for possible employment with Company.

2) Company is solely responsible for the content of any information provided or submitted to CAD Recruiter.com and for ensuring the accuracy, propriety, truthfulness, and legality of all of information it submits and provides to or on CAD Recruiter.com. Company is also responsible for updating each its employment listings on CAD Recruiter.com which changes in the listing or by having the listing removed as soon as the position is no longer available.

3) Company acknowledges that CAD Recruiter.com shall function solely as a website facility for the receipt, storage, processing, and transmission of Company employment listings and other submitted data, and resumes and supporting information submitted by employment candidates or prospects (hereinafter referred to as "Candidates"). Brighton Designs is not responsible for monitoring, evaluating, reviewing, or assessing any job listing or Candidate resume or supporting data or verify or warrant the accuracy of any such listing, resume, or information submitted by Company or Candidate.

4) Company agrees to submit to CAD Recruiter.com only job listing information and material which is valid, accurate, relevant to this website and related to the specific purpose of notifying job candidates and prospects about employment opportunities at or with Company. Brighton Designs may, without notice and for any reason, remove any job listing or other information from CAD Recruiter.com, including, resumes, candidate information, employment listings, descriptions, employer registrations, candidate registrations or otherwise. Brighton Designs further reserves the right in its sole discretion to deny any persons or Company's access to or usage of CAD Recruiter.com or CAD Recruiter.com or any portion thereof. In the event that Brighton Designs deny's any persons or company's access to or usage of CAD Recruiter.com or CAD Recruiter.com, Brighton Designs, Inc. will inform that person or company by email or mail or certified letter that they are being denied access to CAD Recruiter.com. Any visits or use of the site at this point will constitute unauthorized use and Computer Trespassing and legal action will be taken against that individual or company. In the event that the person or company continues to visit or use CAD Recruiter.com or CAD Recruiter.com after denial of use notification has been made, individual or company agrees to compensate Brighton Designs, Inc. $1,000 per page click or page visit made to CAD Recruiter.com or CAD Recruiter.com from their IP address or any IP address being utilized by their employee plus all attorney fees, costs and other damages associated with legal action.

5) Company agrees not to use CAD Recruiter.com or information obtained from that website in any manner which is or may be competitive, unethical, illegal, fraudulent, defamatory, obscene, threatening, abusive, libelous or harassing or which may infringe any right protected under local, State, Federal or International law, including, but not limited to any intellectual property right, trademark, copyright, patent, privacy right, publicity right, common law right, or any other protected personal or private right of any person, entity or thing.

6) Company agrees that all design, layout, software, text, functions, operations, and data contained on or used by the CAD Recruiter.com website (hereinafter "Proprietary Materials"), other than the information submitted by Company or Candidate, are the sole and exclusive property of Brighton Designs and are protected by copyright, service and trade marks, and/or other Federal, State and International laws providing protection to its website, Proprietary Materials, Brighton Designs and/or its related companies. In consideration for the fees paid to Brighton Designs by Company to use the CAD Recruiter.com website in the manner herein stated, Brighton Designs hereby grants Company a limited, nonexclusive, nontransferable and temporary license to access and use CAD Recruiter.com and Proprietary Materials contained thereon. However, Company shall not, nor permit any others under its direction, control, instruction or knowledge to: (a) use CAD Recruiter.com for purposes other than those set forth herein; (b) copy, adapt, display, transmit, store, sell, or use any Proprietary Materials on or from CAD Recruiter.com; (c) attempt to remove or remove from, download, copy, recreate, disassemble, modify, destroy, translate, reverse engineer, or tamper with any Proprietary Materials on CAD Recruiter.com; or (d) assign, sell, sublicense, lease, or otherwise transfer the limited license that Company may receive under the terms of this agreement, to use CAD Recruiter.com or any Proprietary Materials.

7) Company hereby grants Brighton Designs the right to use, copy, or modify, any communications or information submitted by Company to CAD Recruiter.com. for use or display on that website. Company shall have no legal recourse against Brighton Designs for any alleged or actual infringement of any of Company's proprietary rights to communications or information submitted for use on the CAD Recruiter.com. website. Company hereby consents to Brighton Designs' use of and its listing of Company's name in CAD Recruiter.com's list of subscribing Companies.

8) Company may terminate its use of the CAD Recruiter.com website with 30 days written notice. In the event of any violation of this Agreement by Company, Brighton Designs reserves the right to terminate any or all services provided to Company . Company may only use those services authorized and for Company's own use. If Company's access is protected by a password, Company will not make its password or other relevant account information available to others, nor will Company use the password or other relevant account information of another user.

9) Brighton Designs does not assure or otherwise guarantee Company that any Candidate will respond to any job listing posted at CAD Recruiter.com or that CAD Recruiter.com will identify any Candidate which meet Company's employment requirements or expectations. Brighton Designs expressly disclaims any warranty as to the truthfulness or accuracy of any information provided by Company or by Candidate on CAD Recruiter.com and makes no warranty as to the accessibility or availability of CAD Recruiter.com. Company recognizes that Brighton Designs is not responsible or liable for any interference or down-time that Company may experience on the CAD Recruiter.com website, or for the errors, delays and interruptions caused during the use or operation of the Internet, including errors in receipt or transmission of information and data. In no event shall Brighton Designs be responsible or liable for any damages from Company's use of or inability to use CAD Recruiter.com or the system by which Brighton Designs' services are provided. Brighton Designs' liability, if any, in the event of any loss or damage or claim whatsoever, shall be limited to the fees and charges, if any, paid by Company to Brighton Designs for CAD Recruiter.com services which resulted in any such alleged loss or damage.

10) Brighton Designs does not warrant the truthfulness or accuracy of any information or representations provided to Company or to CAD Recruiter.com by any Candidate Brighton Designs does not authorize any current employee, agent, contractor, subcontractor, or independent contractor of or with Brighton Designs, to submit their own resumes or any information in support of their own resumes for posting on CAD Recruiter.com. Brighton Designs shall not monitor, interview, examine, evaluate or verify qualifications of any Candidate or any resume or information submitted to CAD Recruiter.com by any Candidate.

11) Brighton Designs does not warrant any Candidate's skills, workmanship, qualifications, condition, integrity or quality of work or service. Brighton Designs is not responsible or liable for any acts of any Candidate, whether such acts are alleged negligent, reckless, intentional, criminal or otherwise (hereinafter referred to collectively as "Candidates' Acts"). Company specifically agrees to indemnify and defend Brighton Designs against any claims, damages, costs, liabilities, attorneys' fees or litigation expenses (hereinafter referred to collectively as "Losses") sustained or incurred by Brighton Designs for any Candidate's Acts arising out of or occurring during their employment with Company, or which allegedly occurred during interviews or as a result of communications or interactions between Candidate and Company.

12) Company shall indemnify and defend Brighton Designs against any Losses sustained or incurred by Brighton Designs resulting from or related to Company's use of CAD Recruiter.com or any information submitted by Company to CAD Recruiter.com, including, without limitation, in connection with claims of fraud, breach of contract, defamation, harassment, infringement, discrimination, any other tort or violation of personal, private or property rights, intentional or criminal acts, and/or Company's actual or alleged violation of any employment or any other law or regulation. In addition to the preceding, Company specifically agrees to indemnify and defend Brighton Designs against any Losses resulting in claims against Brighton Designs by any employment recruiter related to any Candidate retained by Company.

13) Company agrees that Connecticut law shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the Federal and/or State courts in Hartford.

Terms of Use for Employment Job Hunters (Authenticated Users)
Any person who submit resumes or supporting information to be posted on CAD Recruiter.com or who assess or review CAD Recruiter.com for the purpose of reviewing job postings in order to secure employment or interview opportunities, is considered to be and is hereinafter referred to as a "Candidate" and is subject to the following terms and conditions:

1) The Candidate's sole purpose in using services provided by Brighton Designs, LLC. d/b/a/ CAD Recruiter.com (hereinafter referred to as "Brighton Designs") is to access and use the CAD Recruiter.com website to review employment opportunity listings posted by potential employers/companies (hereinafter referred to as "Company") and to post resumes for possible contact and employment by or with Company.

2) Candidate is solely responsible for the content of any resumes or information provided or submitted to the CAD Recruiter.com website and any and all use of such information by users of CAD Recruiter.com. Candidate shall be exclusively responsible for ensuring the content accuracy, completeness, truthfulness, relevance, and legality of all resumes and information he or she submits and provides to or on CAD Recruiter.com. Candidate accepts sole responsibility for any communication with or information provided to any Company or potential employer or any other users of CAD Recruiter.com.

3) Candidate acknowledges that CAD Recruiter.com shall function solely as a website facility for the receipt, storage, processing, and transmission of Candidate's resumes and other information and material as well as Company employment listings, Company data and other information. Brighton Designs is not responsible for monitoring, evaluating, reviewing, or assessing job listing or Candidate resume or supporting data or verify or warrant the accuracy of any such listing, resume, or information submitted by Company or Candidate.

4) Candidate agrees to submit to the CAD Recruiter.com website only resumes, information and material which are appropriate, relevant, valid, truthful, accurate, and related to the purpose of identifying Candidates qualifications for job listings. Brighton Designs reserves the right to remove, without notice and for any reason, any resumes, information or material received from any Candidate. Brighton Designs further reserves the right in its sole discretion to deny any person, Candidate, or Company access to or usage of CAD Recruiter.com or any portion thereof.

5) Candidate agrees not to use CAD Recruiter.com or information obtained from that website in any manner which is or may be unethical, illegal, fraudulent, defamatory, obscene, threatening, abusive, libelous or harassing or in any manner which may infringe any right protected under local, State, Federal or International law, including, but not limited to any intellectual property right, trademark, copyright, patent, privacy right, publicity right, common law right, or any other protected personal or private right of any person, entity or thing.

6) Candidate agrees that all design, layout, software, text, functions, operations, and data contained on and/or use by the CAD Recruiter.com website (hereinafter "Proprietary Materials"), other than the information submitted by Company or Candidate, are the sole and exclusive property of Brighton Designs and are protected by copyright, service and trade marks, and/or other Federal, State and International laws providing protection to its website, Proprietary Materials, Brighton Designs and/or its related companies. Candidate specifically agrees to access and use CAD Recruiter.com and Proprietary Materials contained thereon only for the purposes stated herein, and for no other purpose. Candidate further agrees that he or she will not copy, change, display, transmit, store, sell, or use any Proprietary Materials on or from CAD Recruiter.com or remove or attempt to remove from, download, copy, duplicate, reproduce, disassemble, modify, destroy, translate, reverse engineer, or tamper with any Proprietary Materials.

7) Candidate hereby grants Brighton Designs the right to use, copy, or modify, in any form, any communications or information submitted by Candidate to CAD Recruiter.com. Candidate shall have no legal recourse against Brighton Designs for any alleged or actual infringement of any of Candidate's proprietary rights to information or data that Candidate submits to CAD Recruiter.com. Candidate hereby consents to allow Brighton Designs to compile and/or list Candidate's name for any purpose, including identifying, classifying and/or organizing Candidates or Candidates' information.

8) In the event of any violation of this Agreement by Candidate, Brighton Designs reserves the right to terminate any or all of Candidate's use of the CAD Recruiter.com. website. Candidate may only use those services authorized and stated herein for Candidate's own use. If Candidate's access is protected by a password, Candidate will not make its password or other relevant account information available to others, nor will Candidate use the password or other relevant account information of another user.

9) Brighton Designs does not assure or otherwise guarantee Candidate that any Company will respond to any resume posted at or submitted on CAD Recruiter.com. Brighton Designs expressly disclaims any warranty, including any warranty pertaining to the accuracy of any information provided by any Company on CAD Recruiter.com. Brighton Designs makes no warranty as to the accessibility or availability of CAD Recruiter.com to Candidate.

10) Brighton Designs makes no representation or warranty of any kind, express or implied, relating to information submitted by any Company or for the information provided at or on CAD Recruiter.com. In no event shall Brighton Designs be responsible or liable for any damages resulting directly or indirectly from any Candidate's use of or inability to use CAD Recruiter.com or the system by which Brighton Designs' services are provided.

11) None of the Companies that post jobs, positions or any other information on the CAD Recruiter.com website, are related to Brighton Designs or any of Brighton Designs companies, either as partners, subsidiaries, parent companies, or otherwise, and Brighton Designs is not responsible to them or for their actions or representations in any way. Brighton Designs is not responsible for monitoring, evaluating, reviewing, or assessing any job listing or Candidate resume or supporting data or verify or warrant the accuracy of any job listing, resume, or information submitted by Company or Candidate to or on the CAD Recruiter.com website.

12) Brighton Designs does not warrant the accuracy of any Company's job listing or information posted on the CAD Recruiter.com website nor does Brighton Designs warrant the condition of the Company's business, operations, rules, compensations, work conditions or otherwise. Brighton Designs is not responsible or liable for any acts or omissions of any Company, including, but mot limited to acts or omissions which may be negligent, reckless, intentional, criminal or otherwise arising out of or occurring during Candidate's interview or employment with Company, or which allegedly occurred during or as a result of any communications or interactions between Candidate and any Company. Brighton Designs is not responsible or liable for any claims that Candidate may have or allege against Company, including, but not limited to those involving fraud, breach of contract, defamation, harassment, infringement, discrimination, any other tort or violation of personal, private or property rights, intentional or criminal acts, and/or Company's actual or alleged violation of any employment or any other law or regulation.

13) Brighton Designs reserves the right to be able to enter any resume sent thru this site into it's database. Any candidate not wanting their resume entered into the Brighton Designs database must specifically request that it be removed.
